    Civil Disobedience and Its Justification in Respect to Moral Aspects

    Civil disobedience has been a central issue in recent times in the field of political philosophy. The most important moral question related to the problem of civil disobedience concerns the limits of a citizen's obedience owed to the state. The problem of political obligation raises questions such as: 1. To what extent does the citizen have an obligation to obey the laws of the state? 2. Is the citizen of a state, whether democratic or otherwise, under an obligation to obey the unjust laws of the state? There are two different positions or viewpoints concerning the character of the obligation to obey the laws of the State. 1. The first position states .........."one has an absolute obligation to obey the law and therefore disobedience to the state law is never justified". 2. The second position asserts -------- "one has a Prima facie obligation to obey the law, but this obligation can be overridden by conflicting obligations. Hence, disobedience to the state law can be justified in the presence of outweighing circumstances".

    Simultaneous Elections: A Sure Recipe for Democratic Disaster

    The journey of India’s democracy has been an exciting and remarkable one. It has traversed several unchartered and difficult paths. Elections have been one of the core components and drivers behind this project of democratic expansion and consolidation. With changing times both the scale and mode of conducting elections have also changed drastically. While in the earlier years simultaneous elections of both the Lok Sabha and the State Assemblies took place, in the last fifty years this system became defunct. But recently the present incumbent government has pushed for renewing this system of conducting simultaneous elections. This paper argues that with the changed socio-political scenario revival of this system is not in the best interest of the nation’s democratic fabric. It highlights that the arguments put forward behind the desirability and feasibility of the said proposal largely based on faulty assumptions and lack sound argumentative base. Delving into the various layers of the issue, the paper underlines the core point that though on a technocratic level conducting simultaneous elections might seem highly appealing, but from a perspective of democratic fructification, this system is bound to prove regressive and counter-productive.     “STATE, NGO’s and Ecotourism: A Study of Select Ecotourism Projects of Sikkim

    The present study seeks to address the understanding of community-based ecotourism projects in Sikkim associated with how community-based ecotourism has been able to promote sustainable tourism and at the same time understand what has been the nature of interlinkages between the state, NGOs, and the local community in the promotion of sustainable ecotourism in the region under focus. The study also seeks to look into the degree of freedom given to the communities in planning and managing ecotourism in the context of hegemonic state-market relations in the area under focus. The present study focused on the Ecotourism Policy and the nature of the linkage between the government of Sikkim, the local NGOs, and the local community of the Ecotourism destination. We would probe the successes as well as the weaknesses of the projects and in the process address the question of how to promote and sustain community-based ecotourism. A major success has been the emergence of a community-based Non-Government Organization. NGOs have a potentially valuable role in supporting and building the capacity of local communities to participate in ecotourism programs, especially in defining the zoning and designing interpretation materials and facilities. Many NGOs have been participating in the tourism industry based on their different aims, but their major involvement has occurred within the area where tourism is linked with the local Community and environment; "community-based ecotourism''. Field trips were undertaken to study the ET projects in Sikkim. No study has focused on the conditions of the operation as well as the outcome of these projects. The present study seeks to examine Sikkim's Ecotourism Policy establishing the state as an ultimate and unique ecotourism destination offering memorable and high-quality learning experiences to visitors while contributing towards poverty alleviation and promotion of nature conservation. In Sikkim, though ecotourism projects are in operation, studies have focused on community participation and promoting conservation and sustainable development

    Tax Liability Issues of Transfer Pricing in International Transactions with specific reference to the Partial Intellectual Property

    The Government acts as the parent and protects its people like children. Initially, Government was entrusted with the duty of protector but now the government functions for the development of people and to increase the standard of living. Government is a welfare state and utilizes all money for the development of its people. The government may accumulate revenue through different methods such as fees collected for government, direct tax, indirect taxes, providing license for business or individual performance, fines collected for the violation of traffic rules, etc., and collected revenues spent for people. The tax is one of the major sources of revenue collected based on income and consumption. Intellectual property is the property created by human intellectual, skill and intellectual labour, etc., The present research plans to drive the study towards how partial intellectual property escapes from tax liability. Generally, these transactions are done between two custom frontiers of different territories. As per Income Tax Act-1961, these transactions are covered under the name of transfer pricing. But, it covered tangible property, services, and financial transactions. Income tax provisions and methods are not useful for levy tax on the transfer of partial intellectual property and other intellectual property. Multinational companies have appointed technical experts to exclude tax liability by invoking tax loopholes. There are various methods used to evade the tax liability of the above- mentioned transactions. The research will identify the research gaps and fill those gaps with appropriate suggestions.
