Item Open Access Cyber Crime Vis-À-Vis Violation of Massive Human Rights and Legislative Efficacy in India(University of North Bengal, 2020-09) Herode, Pramod J.Cyber crime is the phenomenon in the age of Information and Technology; neither has it geographical boundaries nor typological limit. The enormous growth in I.T. has closely intersected social life of an individual to such an extent that India stands at second number in the array of high numbers of users of internet. Under the garb of paper less governance, it is adopted as e-governance by public and private sectors. It has now close concern with right to privacy a basic human right of individual. Considering the wider amplitude of cyber crime legislative mechanism has been provided by the government as I. T. Act specifically enacted and certain provisions of IPC and Personal Data Protection Bill, 2019 are for additional support. However, epistemological data of ever increasing cyber crime shows inefficiency of legal framework at two places one efficacy of law and implementation of law. investigating agencies are not equipped with update knowledge and infrastructure, consequently victim is deprived of justice in consequence alarming situation is inevitably warrant for prompt and efficient legal and implementing mechanism which is sine qua non for public security.Item Open Access Cyber Terrorism and International Humanitarian Law(University of North Bengal, 2019-09) Sinha, SreoshiTerrorism, the most violent form of perpetration has existed since the inception of human civilization. Though the conventional motives have remained the same, the traditional concepts and methods of terrorism have evolved into deadlier forms with the advancement of modern technology. Information technology is one such area which has increasingly allured the terrorists over the years due to the garb of anonymity it offers to the perpetrators of terror. The increased reliance on information technology by the terrorists has significantly given rise to security dangers and hence this new menace became a major challenge to world security and the phenomenon that evolved came to be known as cyber terrorism. The disastrous impacts associated with cyber terrorism made it all the more impossible to be control or prevented. The issues of safeguarding against the threatening of such operations still remain uncertain. Hence the Geneva Conventions or the current Law of War remains relevant to cyber terrorism, but yet the precise points of pertinence remain largely unclear. My central argument would dwell upon whether the International Humanitarian Law or the Law of War would be effective in preventing this newest form of terrorism or not.Item Open Access Social Memory in Internet Age(University of North Bengal, 2020-03) Shinde, Vishal B.Someone might ask a question that why do we need to forget something? It can also be argued that memory to store information then whyto forget something willfully? Remembering is a positive whereas forgetting is a negative task etc. Though these questions seem valid, we have to take the fact in mind that remembrance is not necessarily beneficial all the times. Similarly, forgetting is not necessarily a negative task all the times. Forgetfulness has its own value. In this paper researcher attempts to explain importance of forgetfulness and social memory in the internet age. Researcher has also tried to through some lighton how the forgetfulness could benefit our society and Remembrancecould prove harmful to the society in certain situations.This piece of research is to explore the value of forgetfulness against the concept of Remembrance. Why forgetting is necessary in several situations and how Remembrance can prove to be harmful is discussed here in detail.
